Given the strangeness of the circumstances surrounding the aircraft's disappeance (a large, modern airliner of a tyoe with an excellent safety record simply disappeared off radar with no trace), bloggers like Boggart Abroad were entirely justified in asking during the 72 hours between the loss being reported and news of the debris, WTF was going on.

Now the story that is supposed to quell rumour and gossip is actually raising more questions. And then there's this:

from Prison Planet

AirAsia CEO Tony Fernandes dumped 944,800 shares in Tune Insurance Holdings Bhd, the organization that provides travel insurance for AirAsia passengers, just days before the disappearance of Flight QZ8501.

On December 26, the Malaysian Insider reported that Fernandes, the founder of Tune Group Sdn Bhd which owns AirAsia, had sold a total of 944,800 shares in Tune Insurance Holdings Bhd, with 850,000 shares being dumped on December 22, and the other 94,800 being sold the day after.

According to its official website, Tune Insurance Holdings Bhd is “an insurance product manager” for AirAsia in which “insurance products are sold to (AirAsia) customers as part of their online booking process.”

The share prices of AirAsia and Tune Insurance Holdings both fell on the first day of trading after the disappearance of Flight QZ8501, with the former shedding 12.9 percent at one point. Tune Insurance Holdings lost 0.6%.

Fernandes decision to dump the shares less than a week before AirAsia Flight QZ8501 disappeared over the Java Sea prompted some to speculate that he may have had prior knowledge of the incident.

“Did Fernandes know his company stock was about to take a hit? The timing is suspicious,” asks, adding, “If so, it indicates knowledge of an impending attack on AirAsia.”

The International Business Times adds that the move has prompted many to voice the theory that Fernandes, “possibly knew about an impending attack on one of the company’s aircraft.”

The story bears some similarity to the unusual market activity in airline stocks that preceded the September 11, 2001 terror attacks. An “extraordinary” amount of ‘put options’ – speculation that a stock price will fall – were placed on United and American Airlines in the days leading up to 9/11.

Published under Creative Commons licence granted by Prison Planet

We can only speculate as to the reasons Mr. Frenandez sold a big protion of his holding in Air Asia and the timing of the same, and at this stage one opinion is no better than another. What we do know is that the sell off happened, that much is a matter of public record as required by stock exchanges around the world. Given the timing of the sale, to suggest it is pure coincidence is stretching our credulity a little too far.

Other sources are saying the accident may have been due to a pilot / air traffic control worthy of amateurs. The pilot however was a vastly experienced flyer who knew the area and understood the conditions.

The plane’s pilot then asked to increase altitude from 32,000 to 38,000 feet due to the weather conditions, but the request was denied because there were six other planes in the vicinity. The pilots were instead approved to increase their altitude to 34,000 feet. Within three minutes, the plane had disappeared from radar contact entirely.

Unconfirmed secondary radar data of the plane’s flight reportedly show the plane was climbing toward 36,000 feet, at a speed of 353 knots, or approximately 650 kilometres per hour. Geoffrey Thomas, a Sydney-based aviation expert, said that, if true, this would be below the minimum safe speed for this altitude.

“The QZ8501 was flying too slow, about 100 knots [160 kilometres per hour]... too slow,” he told the British Daily Mail. “Essentially the plane is flying too slow for the altitude and the thin air, and the wings won’t support it at that speed and you get a stall, an aerodynamic stall.”

According to the newspaper, aviation experts have suggested that a build-up of ice on airspeed sensors, known as pitot tubes, might have given the pilots an incorrect speed measurement. False speed measurement due to icing is known to have contributed to the crash of Air France Flight AF447 on June 1, 2009 over the South Atlantic Ocean. The plane’s pilots were known to be manoeuvring to avoid storm clouds.

Thomas also said that the Airbus 320 is not equipped with the latest radar system for measuring storms and this may have led the pilots to misjudge the storm’s severity

Military Generals Move To Arrest Obama After They Find ‘Proof’ He Armed ISIS

obama - contempt for his country's laws
Obama has shown contempt for his country's laws and behaved like a Roman Emperor

We are not familiar with this source, therefore post a caveat with the story, the arrest part should be taken with a pinch of salt unless you hear it on television or radio news. The part dealing with the USA arming the ISIS terrorists rings very true however.

As has been widely suspected and speculated upon, President Obama and his administration have been accused of engineering a sequence of events that led to the emergence of Islamic extremist terror group ISIS, and has also provided them with the arms they are now using in their brutal attacks against Shi'ites, Christians and other minorities in ISIS occupied areas of Syria, Iraq and Kurdistan. The group's investigations reveal that at least some of the weapons being used by the terrorist organization are of U.S. manufacture.

According to reports, the investigation was conducted by Conflict Armament Research, a small-arms research organization in London. The study included photographs that indicate that weapons were “seized by Kurdish forces from militants in Iraq and Syria over a 10-day period in July.”

The group had reportedly confiscated “significant quantities” of M16 rifles and other weapons, that were manufactured in the USA. The report concludes that the weapons most likely got into the hands of ISIS via Syrian rebels armed with the help of Saudi Arabia. That is in addition to the arms that were stolen upon the defeat of Iraqi army groups.

Obama’s support for Iraq, Libyan rebels, and Syrian moderates has ultimately resulted in the literal passing of the gun to our enemies. If you cast your mind back to Obama's first Presidential campaign in 2008, to the delight of rapturous 'liberals' he pledged that in any revolution of civil conflict around the world his administration would support the rebels.

It was a policy that stood in total violation of the United nations charter but even so was lauded by those idiotic bigots who constantly screech about human rights and equality although they clearly have a strange idea of what rights anyone who disagrees with the USA's rent boy President is entitled to. The right to life is not among them as is demonstrated by the Obama administration's warmongering foreign policy record.

German Police See Rise In Far Right Extremism

The rise of anti - EU parties UKIP in Britain, the Front National in France and the Sweden democrats, all three of which are exploiting deep seated social unsease as the political elite's consensus policy that uncontrolled immigration is great for countries struggling with economic problems, unemployment and the burden of massive sovereign debt generated because of equally loonytoons consensus policies on welfare benefits.

These policies, adopted throughout the developed world have saddled the taxpaers with unserviceable debts and the last thing nations need is massive influxes of low skilled, poorly educated migrants who don't speak the langage of the nation they expect to support them, have nothing to offfer economically or culturally and have no intention of integrating with the national community (to the extent that immigrant factions are demanding the british, French, Swedes, Danes and so on abandon custioms and traditions to integrate culturaly with the immigrant communities.

Such contempt from the useless, parasitic tax eaters who have wormed their way into the elite, the academics, media and showbiz luvvies was bound to lead to a backlash sooner or later. So far it has been political, but in some areas, where the governing elitists are most determined to turn Europe's ancient civilisations into third world shitholes, things are starting to take a nasty turn.

Germany, where the embyonic anti - EU movement AFD have not progressed as far as UKIP, the FN or Five Star, neo - Nazi groups are starting to spring up. Read more at The Local, Germany:

French Goss Mag Outs Gay Politician, Sparks Privacy Row

by Arthur Foxake

Gossip magazine Closer has sparked a privacy row in France after it outed a homosexual senior member of France's right - wing National Front party. Closer published photos of the man with his male partner. Politicians and journalists have reacted angrily to whhat they call a gross breach of privacy.

Florian Philippot, one of FN’s vice-presidents and a senior colleague of Presidential hopeful Marine Le Pen, is shown on the cover of the latest edition of Closer, walking beside a man (whose face has been smudged out) next to the headline ‘Yes to love for everyone’ (Oui a l'amour pour tous).

The headline is a parody of the anti-gay marriage movement "Le Manif pour tous" (Demo for all), which was backed by the NF. There is an example of left wing stupidity and bigotry in it however, typically for the left whose followers are pensees unique (many people with one thought) who sign up to a package of beliefs and principles, they assume all other political movements impose a similar lack of diversity on followers.

Thus, to the left, it is not possible to be opposed to uncontrolled immigration without being trenchently opposed to same sex marriage. This is a ridiculous position to hold of course, people have a wide range of opinions and then to support political groups whose policies are in live with a voter's values and principles. It is poerfectly reasonable to be in favour of free immigration and oppposed to same sex marriage and vice versa.

And of course there are many gay and lesbian people who have no interest in 'marriage', are quite content with the civil union arrangement and think the marriage campaign by gay activists was deliberatly provocative and has been counter productive.

One of the biggest tasks facing france's F N, the UK Independence Party (UKIP) and other new parties such as Alternatif Fur Deutschland is to break the grip of propaganda that has created the pensee unique in the 20 - 35 demographic, the idea that there is only one correct way of thinking.

The Philippot story is shocking not so much for the revelation of Philippot’s sexuality but for Closer magazine’s audacity and apparent willingness to invade the privacy of public figures. While it has become a principle of the gay lobby and the Internet generation in the USA and UK that every detail of our lives should be made public, in much of Europe the Geneva Convention right to privacy is still cherished.

A major step forward for the left would be to demand the same level of accountability on financial and political matters (has anyone read the documents leaked from the TTIP and TPP negotiations?) as the level of transparency they demand on private matters.

"It is Unacceptable even though I don’t support his ideas, the right to privacy is sacred,” added socialist deputy Nicolas Bays.

Perhaps most expected of all the reactions was that of Front National boss Marine Le Pen, who has previously spoken out against gay marriage (NB: Mlle Le Pen has not suggested she disapproves of homosexuality, only that she is against same sex marriage.) WIt’s intolerable. If the publications accused of invading people’s privacy were forced to pay back the money they make from the revelations, they wouldn’t do it anymore," Le Pen told French radio station Europe1.

Closer’s editor Laurence Pieau defended the magazines story on the same radio station, arguing that any high-profile figure or politician would inevitably have their private life exposed.

"How can you expect the number two of the National Front, who could even reach power in France, to be able to achieve such a position without disclosing information about his or her family, relationships, or without having a wife or friends?" Pieau claimed. This is a somewhat spurious point, that someone else might do it if you don't is not a justification for an immoral action.

Closer last made international headlines in January 2014 by publishing a story revealing French President François Hollande’s secret affair with actress Julie Gayet while his partner Valérie Trierweiler was still being presented as France's first Lady.

Gayet later won a privacy lawsuit against Closer and another tabloid magazine for photos they published that were considered a breach of her privacy.

All together it is more evidence that the pushback against the left / gay / global nation bullying is gathering momentum.

Google News quits Spain in paid content row

Spain's government on Thursday defied Google's vow to shut down its Spanish online news service in protest at being made to pay for content, a move that seriously threatens smaller media outlets, one industry insider told media representatives. The internet search giant threatened to close Google News Spain in December, 2014, before an intellectual property law enters force in January obliging Internet news scrapers to pay for content automatically lifted from other websites and displayed on their own services. Spain's culture ministry, responsible for internet law, said it would go ahead and implement the new law. A spokesman said Google's announcement was "a matter for the company". "Despite the suspension of Google News, access to news on the internet will still be guaranteed as it can be found via the news organisations' own websites or web searches. The intellectual property reform does not obstruct freedom of information"," a Spanish Government press statement read. Elsa González, president of Spain's Federation of Journalist Associations commented that the introduction of the 'Google Tax' would damaging digital publications by causing reductions in traffic. "The government's policy is going to hurt a lot of smaller, journalist-run publications in particular," said González, who lamented the fact journalists and photographers — "those who provide the content for media outlets" — hadn't been consulted during the drafting of Spain's new intellectual property law.

Google's problems with The European Union

Google has been involved in many legal disputes with E. U. mamber nations over the years, including Britain, Germany and France. It currently stands accused of exploiting its dominant position in the search market to avoid paying for content. Google argues that its news service drives readers to websites and thus contributes to their advertising revenue. This is somewhat reminiscent of Google's defence against allegations of tax dodgin after the company was found to have paid minimal tax on its multi-million Euro profits. The company said their search technology contributes so much to the cultural, business and social life of nations in which it operates, they should pay for the privilege of having Google operating in their jurisdiction. The European Parliament recently voted through a resolution calling for an EU law force the beak up of search engines to separate their commercial services from their businesses, a move seen as effectively calling for the break-up of Google. In October a legal battle with German publishers forced Google to remove from its search results news snippets and summaries of articles drawn from news sites. Google is rumoured to have reponded by removing the web content of those companies that supported the move from their search results. This has apparently cause some German publishers to cave in and allow Google news scraping. So much for the search monopolists commitment to 'net neutrality'.

Migrant benefits built my £60k mansion. It's like FREE money,' boasts Roma gypsy

by Arthur Foxake

The insanity of Britain's benefit system has again be exposed, this time by a Roma gypsy who has used £60,000 in handouts to create a lavish home back on Romania for his family. Scrap metal dealer Ion Lazar plans to keep up the house with generous child benefit and tax credits funded by UK taxpayers. Handouts have made him so rich he pays tradesmen in cash to build the property in Romania for his wife and three children.

He told The Daily Express, “It’s coming in benefits. It’s like free money, thank you England.”

In a Channel 5 documentary this week he boasts how British taxpayers are funding lavish improvements to the family home in the gypsy village of Argetoaia in southern Romania. In the programme he says: “I know the benefit I can make very easily in England.

The situation was last night labelled a “national scandal” and an insult to taxpayers after official figures showed £30million in child bene?t was sent from Britain to 20,400 families in other European countries in 2012-13. Outrage over child benefit and tax credits has seen David Cameron call for a four-year ban on migrants claiming benefits. Mr Lazar, 36, is able to claim benefits because his part-time wage as a self-employed scrap metal collector in London is so low he pays no tax. He says his children are a passport to £1,700 a month in welfare.

Ukip MEP Steven Woolfe said: “This is further proof of the national scandal of the abuse of our benefits system caused by our open-door migration policy with the EU. We should ban all benefits to immigrants until they have contributed through taxation for at least five years.”

A report last month by think-tank Open Europe showed that a migrant worker with two children earning the minimum wage sees their basic income of less than £200 a week propped up with an additional £330 in tax credits and other benefits. One mother in the documentary opened a restaurant in Warsaw with the £220 a month her husband, who works in a UK factory, sends home. Dia Chakravarty, of the TaxPayers’ Alliance, said:

“These outrageous cases show how badly we need to reform the benefits system.” A Department for Work and Pensions spokesman said: “We have led the way with measures to tackle abuses, tighten immigration routes, and toughen up the rules on access to UK benefits – and we have seen other European countries follow our lead.”

While few people would have a problem with an immigrant of any nationality claiming benefits for a family living in this country, it is quite intolerable that E U rules allow a man from a country where the minimum wage is around £30 a week to claim benefits at UK levels (minimum wage £240ish) which is prividing a luxurious lifestyle for a family living in Romania where the cost of living reflects national wage levels.

That such abuses of the system are sanctioned by EU rules is the only reason anyone should need to be shown why we must leave and thus precipitate the break up of the European Union.

Sweden passes law to criminalize any criticism of immigration

We did not know whether to place this post under the label 'free speech' or label it as 'immingration. On refelection perhaps we should just go with the verbose but true title, "Politically Correct Sweden becomes the first nation to abandon democracy if favour of fascism. In of the the Millenium Trilogy books (Girl With A Dragon Tattoo etc.) on of the charaters, defending his right to attack the government, declares "Without free speech there can be no democracy. And yet here we see the hypocritical Swedish elite abandoning that basic democratic principle in order to suppress open debate about their sacred cow, th open doors immigration policy.

Source: SPEISA

Sweden passes law to criminalize any criticism of immigration

A new law will come into effect in Sweden after Christmas 2014, that will allow people to be prosecuted for criticizing immigration or politician’s unwillingness to tackle the issue. The Constitutional Committee’s report has been voted for in parliament, seen in a letter from the Parliamentary Offices. Member of Parliament Andrew Norlén, member of the Constitutional Committee, has been pushing the issue and he says it will rapidly become a deterrent.

“I do not think it takes very many prosecutions before a signal is transmitted in the community that the internet is not a lawless country, the sheriff is back in town” Norlén said during a one-sided ‘debate’ on the issue in Swedish parliament. This new law is meant to stop Swedish people from complaining about their country being turned into a third world nation. Remember, without freedom of speech there can be no democracy. If you are not allowed to say certain things then parties that support your ideas cannot exist and Sweden is at high risk of turning into a communist USSR-like country. As Gorge Orwell wrote in his dydtopian vision of the future, 1984:
“The past is whatever the records and the memories agree upon. And since the party is in full control of all records, and in equally full control of the minds of it’s members, it follows that the past is whatever the party chooses to make it. Six means eighteen, two plus two equals five, war is peace, freedom is slavery, ignorance is strength.”…George Orwell, “1984”
“Freedom is the freedom to say that two plus two make four. If that is granted, all else follows.”…George Orwell, “1984?
And the opposing view from someone the hypocrites of Politicall Correct Sweden would claim to hate but whose doctrine they are following faithfully:
“When an opponent declares, “I will not come over to your side,” I calmly say, “Your child belongs to us already… What are you? You will pass on. Your descendants, however, now stand in the new camp. In a short time they will know nothing else but this new community.”…Adolf Hitler

So the EU “defeated” Putin by forcing him to cancel the South Stream pipeline. Thus ruled Western corporate media.

Facts on the ground spell otherwise. This “Pipelineistan” gambit will continue to send massive geopolitical shockwaves all across Eurasia for quite some time.

In a nutshell, a few years ago Russia devised Nord Stream – fully operational – and South Stream – still a project – to bypass unreliable Ukraine as a gas transit nation.

Now Russia devised a new deal with Turkey to bypass the “non-constructive” (Putin’s words) approach of the European Commission (EC).

Background is essential to understand the current game. Five years ago I was following in detail Pipelineistan’s ultimate opera – the war between rival pipelines South Stream and Nabucco.

Nabucco eventually became road kill. South Stream may eventually resurrect, but only if the EC comes to its senses (don’t bet on it.)

The 3,600 kilometer long South Stream should be in place by 2016, branching out to Austria and the Balkans/Italy. Gazprom owns 50 percent of it - along with Italy’s ENI (20 percent), French EDF (15 percent) and German Wintershall, a subsidiary of BASF (15 percent).

As it stands these European energy majors are not exactly beaming – to say the least. For months Gazprom and the EC were haggling about a solution. But in the end Brussels predictably succumbed to its own.

Russia still gets to build a pipeline under the Black Sea – but now redirected to Turkey and, crucially, pumping the same amount of gas South Stream would. Not to mention Russia gets to build a new LNG (liquefied natural gas) central hub in the Mediterranean. Thus Gazprom has not spent $5 billion in vain (finance, engineering costs).

The redirection makes total business sense. Turkey is Gazprom’s second biggest customer after Germany. And much bigger than Bulgaria, Hungary, and Austria combined.

Russia also advances a unified gas distribution network capable of delivering natural gas from anywhere in Russia to any hub alongside Russia’s borders.

And as if it was needed, Russia gets yet another graphic proof that its real growth market in the future is Asia, especially China – not a fearful, stagnated, austerity-devastated, politically paralyzed EU.

The evolving Russia-China strategic partnership implies Russia as complementary to China, excelling in major infrastructure projects from building dams to laying out pipelines. This is business with a sharp geopolitical reach – not ideology-drenched politics.

Child sex abuse inquiry in crisis as victims walk away

Elite paedophile scandal - stormclouds gathering over Westminster
Elite paedophile scandal - stormclouds gathering over Westminster

Alleged victims of abuse involved in the historic abuse case currently being investigated by MPs and police have advised Home Secretary Theresa May, that they are ready to withdraw support from the Government's child sex inquiry. Twenty = three individuals, some of whom claim as children they suffered serious and prolonged abuse at the hands on senior Members of Parliament, Senior Civil servants and other high ranking figures in the public sector, sent Mrs May a letter claiming the inquiry is "not fit for purpose".

The threat comes ahead of a meeting between Mrs. May and her advisrs and representatives of victim support groups for child sex abuse survivors on Friday which could lead to the inquiry being further undermined. Alreadt the inquiry has been delayed twice when people appointed to lead it, Baroness Butler - Sloss and Finona Woolf were revealed to have business, social or political links with people named among the aggeged abusers.

The chief executive of the National Association for People Abused in Childhood (NAPAC), Peter Saunders, said his group would withdraw support for the inquiry if Mrs May does not pledge to give it statutory status, which would vastly increse its powers to subpoena evidence.

"We are the largest survivors' group and we have some very significant concerns about this inquiry," Mr Saunders said.

"Mrs May has said she is willing to meet us about our requests but if she says no we will probably walk away.

"I am not hopeful that we will get what we want.

"The Home Secretary has said she is willing to consider granting the inquiry statutory status at some point in the future but that she will not do so at this stage.

"We think this is wrong - it's a deal-breaker."

The withdrawal of NAPAC and other support groups would be a major blow to the credibility of any inquiry.

In the letter sent to Mrs May it was stated: "The Home Office seems to be running the inquiry to meet others’ needs rather than those of survivors and the public.

"We therefore have little option but to end engagement with the Inquiry and call on other survivors, whistleblowers, associated professionals and agencies to follow suit."

The letter claimed the inquiry's terms of reference went "well beyond the original declared intentions ... to investigate government and establishment cover-ups of paedophiles in their ranks".

It accused Mrs May of failing to address potential conflicts of interest among members of the team. The letter suggested the signatories would resume co-operation if the current panel was scrapped and replaced "on a transparent basis".

War by Media and the Triumph of Propaganda

John Pilger in Global Research

Why has so much journalism succumbed to propaganda? Why are censorship and distortion standard practice? Why is the BBC so often a mouthpiece of rapacious power? Why do the New York Times and the Washington Post deceive their readers?

Why are young journalists not taught to understand media agendas and to challenge the high claims and low purpose of fake objectivity? And why are they not taught that the essence of so much of what’s called the mainstream media is not information, but power?

These are urgent questions. The world is facing the prospect of major war, perhaps nuclear war – with the United States clearly determined to isolate and provoke Russia and eventually China. This truth is being turned upside down and inside out by journalists, including those who promoted the lies that led to the bloodbath in Iraq in 2003.

Obama Reverses Policy As US-Turkey Set To Agree On Syrian No-Fly-Zone

American must have been quite shocked to wake up after the Thanksgiving weekend's festivities to dind they are no longer living in what was arguably but proclaimed by many to be the world's greatest democracy, but are now ruled by the God - King Obama, who makes new laws by Imperial decree and considers those who question him criminals.

The coup d'etat that killed off American democracy was carried out while the populace was diverted not only by the holiday weekend but by the carefully engineered civil unrest in freguson Missouri.

Here's what one authoritative resource had to say:

Obama’s Executive Order on Immigration: Usurping Constitutional Authority?

“The magnitude and the formality of it is arguably unprecedented. It’s fair to say that we have never seen anything quite like this before in terms of the scale.” Peter J. Spiro, Temple University law professor

When James Madison first proposed the balance of power concept for the newly created Federal government with three equal branches of government – each independent of the other with clearly defined responsibilities, he may not have anticipated, despite its enshrinement in the Constitution, how easily that balance of power could be so shrewdly subverted.

While President Obama’s recently announced Executive Order makes sweeping changes to the country’s immigration system without Congress, the emerging legal question is whether the President has overstepped his Executive authority and is ultimately usurping constitutional authority in exceeding existing immigration law which requires that those who arrive in this country illegally be deported. While many of us may not like aspects of that law, it is, nevertheless, the law.

In July, 2014, well-known liberal constitutional scholar Jonathan Turley testified before the House Rules Committee that:

“The President’s pledge to effectively govern alone is alarming, and what is most alarming is his ability to fulfill that pledge. When a president can govern alone, he can become a government unto himself, which is precisely the danger the framers sought to avoid . .”

And since the President announced his immigration Executive Order (EO) on November 20th, Turley added:

“What the President is suggesting is tearing at the very fabric of the constitution. We have a separation of powers that gives us balance and that doesn’t protect the branches. It’s not there to protect the executive branch or the legislative branch, it’s there to protect liberty. It’s there to keep any branch from assuming so much control that they become a threat to liberty.”

“What the Democrats are creating is something very very dangerous. They’re creating a president who can go at it alone and to go at it alone is something that is a very danger that the framers sought to avoid in our constitution.”

“What I’m hearing certainly causes great concern that he will again violate the separation of powers,” Turley said. “No president can take on the power of all three branches and that’s what he seems to be doing. He certainly seems to be taking on legislative authority. He isn’t being particularly coy about this, you know he says ‘this is what I wanted to get out of legislation and I’m going to do it on my own’ and that does become a government of one.”

In 2011, Turley represented a bipartisan group of 10 House members who challenged Obama’s constitutional authority to prosecute the war in Libya without congressional approval. Currently, Turley is representing the US House of Representatives in their lawsuit challenging the President’s “unconstitutional and unlawful actions” regarding his “unilateral implementation” of the Affordable Care Act aka Obamacare.

In use by every president since George Washington, Presidential EO’s, originally informal housekeeping directives to Federal officials and agencies, have grown in substance with the ‘full force of law’ as if Congress had acted. EO’s are temporary until the next Executive acts and are subject to judicial review (although courts are reluctant to intervene) while Congress frequently looks the other way. Today, EO’s provide a perfect foil in which to change existing law without encountering significant media or public scrutiny and avoid pesky Congressional oversight.

In addition, it is now apparent that an EO may not be necessary for a scoundrel President to alter the specific language of an established law when, for example, a bill’s original intent is not sufficient to address new circumstances or an essential concept that was mistakenly omitted or simply because the Executive can do whatever the Executive wants. As Madison and the Founders intended, under the US Constitution, the Congress makes the laws and the President is charged with implementation.

While Presidential power is derived from the Constitution’s implied authority contained in the broadly-interpreted ‘executive power shall be vested in the President’ directive (Article I, section 1, clause 1) as well as Presidential responsibility to “take care that the laws be faithfully executed” (Article II, section 3, clause 5), there is no legal mandate that allows the Congress or President to fudge their Constitutional lines of responsibility, regardless of what political differences may exist.

It is against this backdrop that the President risks being accused of an overreach of ‘executive power’ that inevitably raises essential constitutional concerns. The question arises that by deferring enforcement action while establishing a newly created special status for a group of citizens, the President is, in effect, violating the immigration law as enacted by Congress and that the President has gone beyond prosecutorial discretion and into the area of legislating.
